Rental Agreement
Covid-19 Regulations
Face masks that cover both nose and mouth must be used in all common areas including the gym, lobby, hallways, and elevators. Masks are not required while dining at the restaurant, lounging in the pool areas, or swimming. A maximum of 5 people are allowed in the gym at any given time.
Building Rules
The Guest agrees to all rules and regulations of the building administration.
ID Verification Requirements
For international guests, passports must be scanned and uploaded to the reservation via the link provided before the check-in date. For domestic guests, an official ID such as a driver’s license is acceptable if a passport is not available. Guests will not be permitted to check in before completing the ID upload.
Reservation Payment Schedule
A reservation deposit of 50% of the total amount is required to confirm any reservation. The remaining balance is due and will be charged 60 days prior to check-in. If a reservation is made within 60 days of check-in, the remaining 50% will be charged shortly after reservation confirmation.
Refunds and Cancellations
Please refer to the Booking Policy section to learn about the different rates offered. The conditions of the specific rate chosen will determine the Guest’s eligibility for refunds.
Occupancy Conditions
The full names (first and last) of all persons accompanying the Guest must be submitted in writing prior to check-in. Some properties have extra fees if the number of guests exceeds a certain limit. Unauthorized persons are not permitted to stay overnight and will incur a penalty fee. To alter the number or names of persons on the reservation, submit the request in writing to reservations@maxwellpv.com. Extra fees may apply for additional guests.
Security & Damage Deposit
A security deposit is required upon check-in: USD $250 for Casa Pedro and Soho; and USD $500 for Orchid and Indah. It will be charged to the credit card on file upon check-in and refunded within 7 days of departure if there are no damages or missing items. If there is a breach of contract, the full security deposit may be withheld and the Guest is responsible for any additional charges above the deposit amount.
A breach of contract includes, but is not limited to:
- Damage to the property or its contents (including stains of any kind)
- Exceeding the occupancy stipulated on the reservation
- Violating building and/or homeowner association rules
- Smoking inside the property, as well as on terraces where prohibited (a $300 fee may be charged for ionization if smoking is detected)
- Bringing pets without prior authorization
- Parties or gatherings with excessive people or noise
- Noise disturbances
- Illegal or immoral acts
- Maintaining hazardous, poisonous, corrosive, or flammable substances
Guest Behavior Policy
All guests and visitors agree to conduct themselves at all times in an orderly and acceptable manner and not to disrupt the quiet enjoyment of other guests and owners. We reserve the right to immediately terminate the Guest’s reservation if conduct is deemed in breach of this clause. Conduct considered inappropriate includes, but is not limited to:
- Creating an inappropriate level of noise at any time
- Creating any level of noise that could be considered inappropriate or bothersome past 10:00 pm, including shouting, screaming, yelling, or playing loud music anywhere in the property or on balconies
- Drunken, unruly, verbally abusive, or physically violent behavior
- Any behavior that other guests or staff find offensive
- Any actions or behavior forbidden by the building administration
If we terminate your booking, you must leave the accommodation immediately. You will be liable for any damage or loss caused by you or a member of your party. No refunds will be provided for lost accommodation, and we will not pay for expenses or costs incurred as a result of termination.
Conditions of Property
If you find something damaged or broken in the unit, please notify us immediately. Maxwell has, to the best of its ability, provided an accurate description of the property and its condition. All electronics, plumbing systems, air conditioning, fixtures, appliances, and amenities such as Wi‑Fi should be in working order, but may fail at any time. Such failures are not a basis for refunds. We will make every effort to repair items, but repairs are not guaranteed during the Guest’s occupancy, especially over holidays and weekends. The Guest agrees to hold Maxwell harmless from any liability for the condition of the property.
Cleaning & Repairs
Cleaning is included in the reservation cost. The Guest agrees to keep the house, furniture, and furnishings in good order. Removing, adding, or changing furniture without written approval is a material breach of this Rental Agreement and is strictly prohibited. The Guest is responsible for the cost of repair or replacement for any damage or missing items.
Entry of Premises
With the Guest’s permission, which is hereby given, a Maxwell representative may enter the premises during reasonable daylight hours with prior notice if possible and notice immediately thereafter. For inventory and maintenance, a property management employee may need to enter the premises under the same procedure. In an emergency, the owner or servicing agents may enter at any time without permission to make necessary repairs. If the Guest abandons or vacates the premises, Maxwell may terminate this agreement, re-enter the premises, and remove all of the Guest’s property.
Assumption of Risk
There is no lifeguard on duty. Persons using the pools do so at their own risk. The Guest will hold Maxwell harmless from any and all bodily injury and/or property damage arising from the Guest’s negligent acts or omissions.
Child Proofing
No special efforts have been made to childproof the properties. Risks include, but are not limited to, access to the ocean, pool, streets, cleaning supplies, plants, and balconies that may be hazardous.
Furniture
All furniture must be returned to its original location upon departure or an additional charge may apply.
Missing Items
The Guest will be charged for any missing items reasonably attributable to them. Maxwell performs an inventory after departure; missing items will be replaced and charged at cost to the credit card on file.
Personal Property
Personal property of the Guest is not insured by Maxwell. Maxwell is not responsible for any lost, stolen, or missing property, including property left behind after check-out.
Substitution
If the property becomes unavailable for any reason during the Guest’s agreed occupancy, Maxwell reserves the right to relocate the Guest to the best available comparable property. If an agreement cannot be reached, a full refund of all monies paid will be provided.
Unpredictable Weather
No refunds or rescheduling are offered due to unpredictable or dangerous weather conditions. Guests are strongly encouraged to purchase travel insurance.
Liability and Intent
Neither Maxwell nor the property owner shall be responsible for any accidents or injuries to the Guest before, during, or after occupancy. Maxwell, its owners, and agents are not responsible for theft, lost, or stolen items.
Physical Disabilities
Mexico may not conform to international standards regarding accessibility. Please consult with a Maxwell representative before completing your reservation to ensure your needs are met. If a unit is booked without prior consultation and is not accommodating to a particular disability, Maxwell will try to find alternate accommodations but is not responsible for reimbursement of funds paid.
Responsibility
The Guest assumes all risk of damage to any and all personal property of Maxwell, the property owners, and the Guest, including household furniture and goods. By reserving a stay and pursuing activities offered by Maxwell, the Guest voluntarily assumes all risks of injury, illness, damage, or loss to person and property. Any rights or claims shall be governed by the laws of Mexico and determined exclusively by courts in Mexico with proper jurisdiction. The property owners and Maxwell are not responsible for disturbances or inconvenience due to actions of neighbors or the surrounding area.
Use
Properties shall be used only for residential purposes. The Guest agrees to observe and comply with all restrictions, laws, and ordinances affecting the properties or their occupancy.

Booking Policy
Rates and Currency
On maxwellpv.com all reservations are quoted and charged in USD. Prices for add-on services may be quoted or charged in USD or Mexican Pesos (MXN), depending on timing and the specific service.
Reservation Confirmation
All bookings made on maxwellpv.com are considered requests until approved. You will be contacted shortly after completing your booking request to ensure you meet requirements.
Reservation Payment Schedule
A 50% deposit is required at the time of booking to confirm the reservation. If reserved less than 60 days in advance, 50% will be charged at booking and the remaining 50% processed shortly after.
Security & Damage Deposit
A damage/security deposit is required at check-in and will be returned within 7 days of check-out if there has been no property damage or missing items. The amount ranges from USD $500–$1000 depending on the specific property. Please check the individual property listing for accurate deposit information.
Refunds and Cancellations
Flexible booking options may be available for certain properties. We highly recommend purchasing trip cancellation and interruption insurance.
Three Types of Rates
Standard Rate
- Cancel up to 7 days prior to check-in to receive a 50% refund.
- No refunds for cancellations within 7 days of arrival. The standard payment schedule applies.
Non-Refundable Rate
- No refunds. The standard payment schedule applies.
Fully Refundable Rate
- Cancel at least 7 days prior to check-in to receive a full refund.
- No refunds for cancellations within 7 days of arrival. The standard payment schedule applies.
